1. Agreement
By downloading or using the Fajr app ("App"), you agree to these Terms of Use. If you do not agree, do not use the App. The App is operated by IVAA LLC under the Deen Lab brand ("we," "us," or "our").
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not:
- Copy, modify, or distribute the App or its content.
- Reverse engineer or attempt to extract the source code.
- Use the App for any commercial purpose without our written consent.
- Use the App in any way that violates applicable laws or regulations.
3. Prayer Time Accuracy
Prayer times in the App are calculated using the Aladhan API based on your location and standard Islamic calculation methods. While we strive for accuracy, prayer times may vary slightly depending on your precise location, elevation, and local conventions. You are responsible for verifying prayer times with your local mosque or authority, especially during Ramadan or for Jumu'ah. We are not liable for any missed prayers resulting from inaccurate times.
4. Alarm Reliability
The Fajr alarm relies on your device's notification system and operating system scheduling. We cannot guarantee alarm delivery in all circumstances, including when your device is in Do Not Disturb mode, has low battery, has restricted background app activity, or where the OS limits notification delivery. You are responsible for ensuring your device settings allow alarms to function. We are not liable for missed alarms.
5. In-App Purchases
The App offers an optional one-time purchase called the Barakah Plan, which unlocks additional features. All purchases are processed by Apple App Store or Google Play Store according to their terms and policies. Purchases are final and non-refundable except as required by applicable law or as provided by Apple/Google's own refund policies. We do not process payments directly.
A portion of Barakah Plan proceeds supports orphan care through Orphans in Need. This charitable component is part of our mission but does not constitute a tax-deductible donation on your behalf.
6. Intellectual Property
All content in the App — including the name "Fajr," the Deen Lab name and brand, UI design, copy, and code — is owned by IVAA LLC and protected by applicable intellectual property laws. Nothing in these Terms grants you rights to our intellectual property beyond the limited license in Section 2.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of bugs.
8. Limitation of Liability
To the fullest extent permitted by law, IVAA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim shall not exceed the amount you paid for the App, if any.
9. Governing Law
These Terms are governed by the laws of the United States and the state in which IVAA LLC is registered, without regard to conflict of law principles.
10. Changes to Terms
We may update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
